Appellate Experience Matters

Before focusing her practice on divorce and family law, Barbra Amron Weisberg served as an Assistant Attorney General in the Criminal Appeals Division of the Florida Attorney General's Office.

Her appellate background provided extensive experience in legal research, written advocacy, analysis of trial records, preservation of legal issues and the development of persuasive appellate arguments.

Throughout her career, Barbra has continued to handle appellate matters, including family law appeals resulting in published opinions.

In the representative matters below, Barbra's appellate work included researching the legal issues, developing the arguments presented to the appellate court, and preparing appellate briefs and pleadings. These matters were decided on the written submissions without the need for oral argument.

Published appellate decisions provide a public and independently verifiable record of an attorney's involvement in appellate matters. The following cases are representative examples of Barbra's appellate experience.

Why Appellate Experience Matters in Divorce and Family Law

Appellate experience provides a perspective that can be valuable long before a case ever reaches an appellate court.

An appeal is primarily concerned with whether legal issues were properly raised, preserved and decided in the trial court and whether the record supports the rulings being reviewed. Effective appellate work therefore requires careful legal research, precise written advocacy and close attention to the trial record.

Barbra's appellate background influences the way she approaches complex family law matters at the trial level. She considers not only the immediate dispute but also the legal foundation supporting a client's position, the evidence necessary to establish that position and the importance of creating a clear record when significant issues are contested.

This can be particularly important in cases involving complex equitable distribution, business valuation, alimony, substantial financial disputes, parenting issues and other matters in which important trial court rulings may ultimately be subject to appellate review.

Florida Family Law Appeals

An appeal is not a new trial.

Appellate courts generally review the record created in the trial court to determine whether reversible legal error occurred.

Appellate representation can involve:

  • Reviewing the trial court record
  • Identifying potentially appealable issues
  • Evaluating applicable standards of review
  • Researching Florida statutes and appellate decisions
  • Developing legal arguments
  • Preparing appellate briefs
  • Responding to opposing appellate arguments
  • Addressing procedural and preservation issues

Oral argument may occur in some appeals, but many appellate matters are decided based upon the written briefs and record without oral argument. Barbra's published appellate matters listed on this page were resolved without the need for oral argument.

A Foundation in Appellate Law

Barbra's appellate experience began early in her legal career when she served as an Assistant Attorney General in the Criminal Appeals Division of the Florida Attorney General's Office (1995–1998). In that role, she analyzed trial records, researched legal issues and prepared appellate arguments and briefs in criminal appeals before the Florida District Courts of Appeal and the Supreme Court of Florida.

That foundation in appellate work — legal research, written advocacy, record analysis and the preservation of legal issues — continues to inform how she approaches litigation and case preparation in complex family law matters today.
